AVL reserves the right to update the Terms of Use at any time without notice to you. By using this Site, you accept, without limitation or qualification, these Terms of Use. If you do NOT agree to these Terms of Use, please do NOT use this Site.

Important Notice for Amateur Athletes

You are responsible for ensuring that your use of or participation in the activities of this Website does not affect your eligibility as an amateur athlete. Please check with your amateur athletic association for the rules that apply to you. AVL IS NOT RESPONSIBLE OR LIABLE FOR YOUR USE OF THE WEBSITE RESULTING IN YOUR INELIGIBILITY AS AN AMATEUR ATHLETE.

Important Notice for NCAA Coaches

You are responsible for ensuring that your use of or participation in the activities of this Website does not affect your eligibility as an NCAA coach, or violate the specific guidelines of your institution. Please check with your institution for the rules that apply to you. AVL IS NOT RESPONSIBLE OR LIABLE FOR YOUR USE OF THE WEBSITE RESULTING IN YOUR INELIGIBILITY AS AN NCAA COACH.

Children Under Age 13

The Athlete Village does not knowingly collect or solicit personal information from anyone under the age of 13 or knowingly allow such persons to register. If you are under 13, please do not attempt to register for The Athlete Village or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any personal information to or on The Athlete Village. In the event that we learn that we have collected personal information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. If you believe that we might have any information from or about a child under 13, please contact us through the the contact information on our privacy help page.

Children Between the Ages of 13 and 18

We recommend that minors 13 years of age or older ask their parents for permission before sending any information about themselves to anyone over the Internet.

Accuracy and Completeness of Information

While AVL strives to ensure that the information contained in this Site is accurate and reliable, AVL makes no warranties or representations as to the accuracy, correctness, reliability or otherwise with respect to such information, and assumes no liability or responsibility for any omissions or errors in the content of this Site.

AVL does not represent or warrant that the Website will be uninterrupted or error-free, that any defects will be corrected, or that this Website or the server that makes the Website available are free of viruses or anything else harmful.

AVL will periodically revise the information, services and the resources contained in this Site and reserves the right to make such changes without any obligation to notify past, current or prospective visitors.

Your Use of the Site

You may download content for non-commercial, personal use only. If you do download any content form the Site you agree to maintain all copyright, trademark or other proprietary notices and that such notices will remain visible. No right, title or interest in any downloaded materials is transferred to you as a result of any such downloading or copying.

Except for non-commercial, personal use of content, you agree that you will not otherwise copy, modify, alter, display, distribute, sell, broadcast or transmit any material on the Site in any manner without the written permission of AVL.

Downloads of website content for the purpose of consummating business to business transactions with AVL is a permitted use of website content; provided, however, this is a right to use only. As a condition of your use of the Site, you will not use the Site for any purpose that is unlawful or prohibited by these Terms of Use or any applicable laws.

Interactive Use of the Site – The Athlete Village Community Content

You are solely responsible for your User Generated Content, your interactions with other users and your activity on the Website. Do not take any action or post anything that may expose AVL or its users to any harm or liability of any type.

Flaming and insults are prohibited. Do not post User Generated Content, or a link to a website, that, in AVL's sole discretion, is illegal, offensive, libelous, defamatory, infringing, inflammatory, deceptive, inaccurate, misleading, malicious, fraudulent, false, indecent, harmful, harassing, intimidating, threatening, hateful, abusive, vulgar, obscene, pornographic, violent, sexually explicit, invasive of privacy, publicity, intellectual property, proprietary or contractual rights, offensive in a sexual, racial, cultural, or ethnic context, will harm or threaten the safety of others, or is otherwise objectionable. Do not post photos or videos of another person without that person's consent. Do not "stalk," intimidate, abuse, harm or harass another Website user or person.

Do not post personal information, including your email address, IM address, or phone number. Do not collect or solicit personally identifiable information from other Website users or send unsolicited emails or other communications. Do not collect, use or post on the Website the private information of anyone else without their consent or for illegal purposes, including without limitation addresses, phone numbers, email addresses, social security numbers and credit card information.

The Website is not to be used for any commercial purpose. Do not post any advertising, solicitation or commercial content whatsoever on the Website or accept payment from a third party in exchange for your performing commercial activity on the Website. Do not post any User Generated Content that involves the transmission of "junk mail," "chain letters," or unsolicited mass mailing or "spamming." Do not use automated scripts to collect information from, or otherwise interact with, the Website.

Do not impersonate any person or entity, including without limitation athletes or AVL employees. Do not misrepresent yourself, your age or your affiliation with any person or entity. Do not register for more than one AVL account, register a AVL account on behalf of another individual, group or entity, or sell or transfer your profile or account. Do not use or attempt to use another person's account, username or password.

You promise that you own or control all rights in any User Generated Content that you post on the Website. You are responsible for ensuring that any User Generated Content that you post does not, and will not, infringe or violate anyone else's rights, including copyright, trademark, patent, trade secret, privacy, publicity or other personal or proprietary rights. You promise not to submit User Generated Content unless you are the owner or have permission from the owner to post such User Generated Content and grant AVL all of the license rights granted in these Terms of Use.

Do not post any Content, take any action or use the Website in a way that violates any law, would create liability or promotes illegal activities. Do not take any action on the Website designed to interfere, disrupt, damage, disable, overburden or limit the functionality of any computer software or hardware, telecommunications equipment or the Website. Do not post User Generated Content that contains software viruses, programs or other computer code. Do not circumvent or modify any Website security technology or software.

Content is Not Prescreened. AVL does not guarantee to prescreen User Generated Content. AVL does not guarantee the Website will be free from User Generated Content that is inaccurate, deceptive, offensive, threatening, defamatory, unlawful or otherwise objectionable. AVL is merely acting as a passive channel for such distribution and is not undertaking any obligation or liability relating to any User Generated Content or activities of users on the Website. Even in the event AVL chooses to monitor any User Generated Content, AVL assumes no responsibility for, or any obligation to monitor or remove, such User Generated Content. AVL reserves the right to edit, remove, or refuse to post any User Generated Content or terminate your registered account for any reason.

To become a member of the AVL Website, or post User Generated Content, you must register for an account. You agree to provide accurate and current information about yourself in all registration forms on the Website. This Website is intended solely for users who are thirteen (13) years of age or older and it is a violation of these Terms of Use for anyone under 13 to register for the Website. You represent and warrant that you are 13 or older. Your account may be deleted without warning if you misrepresent your age, whether older or younger. If you are between 13 and 18 years old, you must obtain your parent/guardian's permission to register for the Website and post User Generated Content.

AVL’s Rights to Your Posting

Your User Generated Content is not confidential or proprietary. You grant, and warrant that you have the right to grant, to AVL a non-exclusive, non-revocable, worldwide, transferable, royalty-free, perpetual right to use your User Generated Content in any manner or media now or later developed, for any purpose, commercial, advertising, or otherwise, including the right to translate, display, reproduce, change, create derivative works, sublicense, distribute, assign and commercialize without any payment due to you.

Safeguard Your Username/Password

You are responsible for any actions that take place while using your AVL account. Keep your username/password secure and do not allow anyone else to use your username/password to access the Website. You agree to notify AVL immediately of any unauthorized use of your AVL account. AVL is not responsible for any loss that results from the unauthorized use of your username/password, with or without your knowledge.

Unsolicited Submissions

AVL does not accept or consider any creative ideas, suggestions or materials from the public and therefore, you should not make any submissions to AVL either to the Site or otherwise. If you do send us a submission, despite our request not to do so, then such submission will be considered non-confidential and non-proprietary and shall immediately become the property of AVL. As of the date of your submission, AVL shall exclusively own all rights, title and interest to the ideas, suggestions or materials submitted. AVL will be free to use any submitted ideas, suggestions or materials for any purpose whatsoever.

Your privacy is very important to us. We designed our Privacy Policy to make important disclosures about how you can use The Athlete Village to improve your performance, share with others, and how we collect and can use your content and information. AVL does use “cookies” which is a small file of date that is placed on your web browser to store information about your visit to the Site. This information is reusable when you revisit the Site and may make your visit to the Site more productive. If you download any material from this site, you do so at your own discretion and risk. you will be responsible for any damage to your computer system or loss of data that results from the download of any such material.

Termination

AVL may terminate your account, delete your profile and any of your User Generated Content, and restrict your use of all or any part of the Website for any reason, without notice, and without liability to you or anyone else. You may terminate your account at anytime. You understand and agree that some of your User Generated Content, such as that which is displayed outside your profile, in activity feeds, in other parts of the Website, or on other social platforms (e.g., Facebook and Twitter), may continue to appear on the Website or on other social platforms even after your User Generated Content is removed or your account is terminated. These Terms of Use remain in effect even after your account is terminated.

Limitation of Liability

In no event and under no legal or equitable theory, whether in tort, contract, strict liability or otherwise, shall AVL be liable for any direct, indirect, special, incidental or consequential damages arising out of any use of the information contained herein, including, without limitation, damages for lost profits, loss of goodwill, loss of data, work stoppage, accuracy of results, or computer failure or malfunction.
